Expert Witness Reports

Expert witness reports and expert statements in ICT and cyber security for courts, lawyers, companies and law-enforcement authorities.

Electronic evidence is now a routine part of court and commercial disputes. We prepare expert witness reports and expert statements in ICT and cyber security. We put the emphasis on properly preserved source material, professional assessment and conclusions explained in plain language. We work for law firms, companies, courts and law-enforcement authorities.

What you will receive

Expert witness report

A formal report with the expert’s clause and all formalities required by the Czech Act on Expert Witnesses, intended for court or criminal proceedings.

Expert statement

A faster and less formal deliverable for internal decision-making, the pre-litigation phase of a dispute, or cases where a full expert witness report is not yet needed.

From our casework

In a dispute, the circumstances surrounding photographs stored on a mobile device needed to be assessed – in particular whether they were taken by that device, how they got onto it, and whether the user subsequently worked with them.

After forensically preserving the contents of the device, we analysed the related databases, system files and the timestamps of individual artefacts. By cross-referencing them, it was possible to reconstruct the origin of the photographs and any further activity involving them.

The findings indicated that the user most likely did not interact with the photographs any further. We described the conclusions in an expert statement, including the methodology and the material they were based on.

Frequently asked questions

What is the difference between an expert witness report and an expert statement?

An expert witness report is a formal expert deliverable with formalities laid down by law. An expert statement is a simpler form of professional assessment, which the procedural rules for court and criminal proceedings also recognise. It is used where the nature and complexity of the question do not require a full expert witness report. We will recommend the appropriate form for your specific case.

Who can commission an expert witness report?

An expert witness report can be commissioned by a company, a law firm or a private individual. We also prepare reports commissioned by courts and law-enforcement authorities.

What digital evidence can you examine?

We analyse data from computers, mobile devices and other digital sources – for example e-mails, messages, documents, photographs, system logs, metadata and timestamps. The scope of the examination always follows from the specific questions of the case.

Can a device reveal what happened to the data?

In many cases, yes. Digital traces can show, for example, when data was created, deleted, copied or transferred, and whether the user worked with it. The possibilities always depend on the specific device, the available data and the circumstances of the case.

Can you review a report prepared by the opposing party’s expert?

Yes. We assess the methodology used, the source material and the way the expert arrived at their conclusions. The deliverable can be an expert statement, our own expert witness report, or material to support the next steps in the proceedings.

Can important digital traces be lost over time?

Yes. Devices and information systems continuously overwrite some of their data, and certain records are only retained for a limited time. In some cases, important traces can disappear within days. If a dispute or an expert examination can be expected, we recommend preserving the data as soon as possible.

How long does it take and how much does it cost?

It depends on the extent of the source material, the number of devices and the expert questions asked. We will specify the timeline and the price after an initial review of the case.
